    Non-trading Company Income and Gains

    LAST UPDATED 20/02/2024

    AT A GLANCE

    Capital Gains:

When a company makes a profit from selling an asset, 50% of that profit is taxable. Capital losses can be used to offset gains, but only against other capital gains. If losses exceed gains, the extra loss can be used in future years. The intention behind the transaction affects whether the gain or loss is treated as income or capital.

Non-resident corporations are taxed on capital gains from selling certain types of Canadian property. Examples of taxable Canadian property include real estate in Canada, property used for business in Canada, and shares in certain companies. Non-residents need to report sales and obtain a clearance certificate. If not, the buyer must withhold 25% of the sale price. However, tax treaties with other countries may provide relief from these requirements.

    How Tax Natives works.

Tax Natives is an international tax network that connects Explorers (taxpayer clients) with Natives (qualified and regulated tax advisers) from one jurisdiction to another.

    Dividend Income:

Canadian corporations receiving dividends from other Canadian corporations can usually deduct the full amount.

However, specific financial institutions and preferred shares are exceptions.

Dividends from preferred shares have a 10% tax unless the company paying the dividend chooses to pay a 40% tax instead.

There’s a refundable 38.33% tax on dividends received by private corporations from Canadian corporations.

    Stock Dividends:

Stock dividends are treated like cash dividends if paid by a Canadian company.

Dividends from non-residents don’t follow this rule, and the shares received have a cost base of zero.

Interest, Rental, and Royalty Income: These income types are all taxable as income from a business or property.

    Foreign Exchange Gains and Losses:

Gains and losses from foreign transactions are fully included in income or deductible.

Gains and losses on capital transactions are treated like any other capital gain or loss.

Partnership Income: Partnerships are treated as pass-through entities, with partners being taxed on their share of the income.

Corporations can be part of partnerships. Certain deductions and credits flow through to partners.

    Foreign Income:

Canadian corporations pay taxes on worldwide income. They may also be taxed on income earned by foreign subsidiaries.

Double taxation is avoided through tax treaties and foreign tax credits or deductions.

The tax treatment of foreign dividends depends on whether the payer is a foreign affiliate of the recipient.
